1. Acceptance of These Terms
These Website Terms of Use ("Terms") govern your access to and use of www.shutternonsense.com and the articles, podcast content, videos, comments, links, downloads, and other features made available through the website (collectively, the "Website").
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms apply to general Website use. Paid photography workshops, purchases, registrations, and other services may be governed by separate terms, policies, waivers, or agreements. If separate terms conflict with these Terms, the separate terms control for that transaction or service.
2. Who Operates the Website
Shutter Nonsense is currently operated by Michael Rung and Jeffrey Tadlock. References in these Terms to "Shutter Nonsense," "we," "us," or "our" refer to Michael Rung and Jeffrey Tadlock acting together under the Shutter Nonsense brand.
Shutter Nonsense LLC is expected to become the operator after it is formally organized and assumes operation of the Website. We will update these Terms when that occurs.
Shutter Nonsense is based in Fort Worth, Texas, United States.
3. Eligibility and Age Requirements
The public Website is intended for a general audience and is not directed specifically to children under 13. A parent or legal guardian should supervise a minor's use of interactive features where appropriate.
Photography workshop participation and any future alumni community or member area are restricted to individuals who are at least 18 years old. Additional eligibility requirements may apply under separate terms.
4. Educational and Informational Content
Website, podcast, video, and social content is provided for general educational and informational purposes. It reflects opinions and experiences that may change over time.
Content is not legal, medical, financial, insurance, professional safety, or other professional advice. It is not a substitute for current information from land-management agencies, emergency authorities, manufacturers, software providers, insurers, or qualified professionals.
We do not guarantee that information about photography, business practices, products, software, permits, trails, destinations, weather, wildfire, access, regulations, pricing, or other changing subjects is complete, current, or appropriate for your circumstances. We do not guarantee any particular photographic, educational, business, travel, financial, or workshop-related result.
5. Outdoor Activities and Personal Responsibility
Photography and travel may involve risks, including weather, terrain, wildlife, road conditions, remote locations, equipment use, changing access rules, and delayed emergency response.
You are solely responsible for deciding whether an activity, location, route, technique, or piece of equipment is appropriate for you. Consider your experience, health, physical abilities, local conditions, laws, permits, and available safety information.
This section applies to decisions made from free Website or podcast content. It does not replace the separate terms, participant requirements, or assumption-of-risk documents that apply to a paid workshop.
6. Ownership of Website Content
Unless otherwise stated, the Website and its content are owned by or licensed to Shutter Nonsense, Michael Rung, Jeffrey Tadlock, podcast guests, photographers, illustrators, or other contributors. This includes articles, podcast audio and video, photographs, recordings, graphics, caricatures, illustrations, logos, branding, downloads, workshop materials, and Website design elements.
Copyright, trademark, publicity, and other intellectual-property laws protect this material. No ownership rights are transferred to you by your use of the Website.
7. Permitted Use
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for lawful personal and noncommercial purposes.

We may also discuss products or services that were provided free of charge, at a discount, through a sponsorship, or under another material relationship. When applicable, we will provide a disclosure near the relevant content.
Some links may be affiliate links associated with Shutter Nonsense, Michael Rung, or Jeffrey Tadlock. The applicable person or business may receive compensation from a qualifying purchase, generally at no additional cost to the purchaser.
Opinions remain our own unless clearly stated otherwise. A recommendation is not a guarantee that a product or service will meet your needs, remain available, perform as described, or provide the same result for you.
11. Third-Party Websites, Platforms, and Embedded Content
The Website may link to or embed services operated by third parties, including Podbean, YouTube, Spotify, Apple Podcasts, Patreon, social-media platforms, payment providers, affiliate merchants, and other websites or services.

A link, embed, mention, or reference does not necessarily mean that we endorse the third party or every statement, product, or service it provides. Purchases made through a third-party merchant are transactions between you and that merchant.
12. Future Accounts and Community Features
We may introduce member accounts, a private alumni community, file uploads, discussion areas, or other interactive features. These features may be subject to additional terms, Community Guidelines, eligibility requirements, moderation rules, and privacy notices.
Community accounts and alumni access will be restricted to individuals who are at least 18 years old. Do not create an account or use a restricted feature unless you meet all stated eligibility requirements.
13. Workshops, Purchases, and Separate Agreements
Workshop inquiries, registration, payment, participation, cancellations, refunds, conduct, travel, safety, releases, and assumption of risk will be governed by separate Workshop Terms and Conditions and other participant agreements.
Other paid products or services may also be governed by checkout terms, invoices, refund policies, or separate agreements. These Website Terms do not override those documents.
14. Website Availability and Changes
We may change, correct, update, restrict, suspend, or discontinue any part of the Website at any time. We may perform maintenance and may remove content or features without notice.
We do not promise that the Website will always be available, secure, uninterrupted, accurate, or free of errors. We are not required to preserve any particular page, feature, comment, link, embed, or download.
15. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE FULLEST EXTENT PERMITTED BY LAW, SHUTTER NONSENSE, MICHAEL RUNG, JEFFREY TADLOCK, AND THEIR CONTRIBUTORS, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE WEBSITE.
This includes, to the extent permitted by law, loss of data, income, profits, opportunities, equipment, reputation, travel costs, or other losses resulting from Website use, reliance on content, third-party links, unavailable features, security incidents, or user submissions.
To the fullest extent permitted by law, the aggregate liability of Shutter Nonsense, Michael Rung, and Jeffrey Tadlock for claims arising from or related to the Website will not exceed the greater of:

The amount you paid directly to Shutter Nonsense during the 12 months before the event giving rise to the claim for the specific Website service involved.
This limitation does not govern paid workshop participation or another service covered by a separate agreement. It also does not limit liability that cannot legally be limited or excluded.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Shutter Nonsense, Michael Rung, and Jeffrey Tadlock from third-party claims, damages, liabilities, costs, and reasonable legal fees arising from:

This obligation does not apply to the extent a claim results from our own conduct for which indemnification cannot legally be required.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes arising from or related to these Terms or general Website use must be brought in the state courts located in Tarrant County, Texas, or the federal courts serving Tarrant County, Texas. You consent to the personal jurisdiction of those courts.
20. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last Updated" date.
When changes are material, we may also provide a Website notice, email notice, or another form of notice where appropriate or legally required. Changes apply prospectively from the stated effective date.
21. Severability, No Waiver, and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be applied or revised to the minimum extent necessary to make it enforceable where permitted.
Our failure to enforce a provision is not a waiver of the right to enforce it later.
