Shutter Nonsense Workshop Terms and Conditions

These Terms and Conditions govern participation in Shutter Nonsense LLC photography workshops.
1. Release of Liability and Assumption of Risk
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND INCLUDES A RELEASE OF CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF SHUTTER NONSENSE LLC AND CERTAIN OTHER RELEASED PARTIES.
By attending one of our workshops, you are accepting certain risks. Your registration, acceptance of these Terms and Conditions, and payment of your deposit or full workshop fee serve as a release of our liability and an assumption of all risks by you and your heirs, executors, successors, and assigns.
By accepting these Terms and Conditions, you acknowledge that travel, wherever it may be and by whatever means, involves inherent risks of injury, illness, death, loss, or damage to personal property. These risks may result from acts of nature, negligence, or the actions of others.
In consideration of, and as part of the payment for, your participation in a program, workshop, or other activity conducted by Shutter Nonsense LLC, you voluntarily release Shutter Nonsense LLC, its officers, associates, independent contractors, workshop leaders, and others involved in the workshop from damages, liabilities, costs, and injuries, whether mental or physical, known or unknown. By participating, you agree to assume all risks, whether known or unknown.
You voluntarily acknowledge that travel may involve areas that are remote, mountainous, wilderness, wild rivers, remote deserts, or otherwise not maintained to standards to which you may be accustomed. Such locations may involve additional risks, dangers, and inconveniences, including, but not limited to:

Forces of nature and weather conditions

Wild animals
-
Hotel accommodations
-
Airplanes and other vehicles
-
Roads, walkways, and trails
-
Other means of transportation
-
Other known or unknown risks associated with travel and outdoor activities
You acknowledge that medical services and facilities may not be readily available during all or part of the workshop, including access to physicians, medical care, and medication. We assume no liability for medical care.
Unless accompanied by a parent or legal guardian, you must be at least 18 years old to attend one of our workshops.
Your registration and acceptance of these Terms and Conditions signify your full understanding and agreement that you release and hold harmless Shutter Nonsense LLC, its officers, associates, independent contractors, and workshop leaders from any and all liability, actions, causes of action, claims, debts, and demands of every kind whatsoever, known or unknown, that may arise in connection with your participation in activities arranged by them, including claims arising from the ordinary negligence of Shutter Nonsense LLC, its officers, associates, independent contractors, and workshop leaders.
You acknowledge that traveling with a group involves compromise to accommodate the diverse travel goals, personalities, and physical abilities of group members. You also understand that, while itineraries are carefully planned, they are not guaranteed schedules of activities, events, or participation. They are guidelines and examples only.
Participants must allow for flexibility and changes deemed necessary by the workshop leader. Situations beyond our control, including geographic, climatic, physical, or governmental restrictions, may require changes in timing, locations, or activities. You agree that there will be no discounts or refunds for activities affected by such circumstances.
You are responsible for selecting a workshop appropriate to your physical abilities and interests and for being in sufficiently good health to participate in the associated activities. By accepting these Terms and Conditions, registering for a workshop, and submitting your deposit or full payment, you certify that you do not knowingly have any physical condition, disability, or other consideration that would create a risk for you or other participants.
You authorize Shutter Nonsense LLC and/or its workshop leader or leaders to initiate or arrange medical care in the event of a medical emergency.
If, after reasonable accommodations for your physical abilities have been made, the workshop leader determines that your continued participation would negatively affect the rest of the group’s activities, you may be removed from the workshop. Any expenses associated with leaving the workshop are solely your responsibility.
You are responsible for:

Studying all pre-workshop information

Bringing all necessary equipment, personal items, and appropriate clothing

Conforming to reasonable standards of dress and hygiene

Acting in a manner considerate of fellow participants, locations, and environments
We reserve the right to cancel any activity and to accept or reject any person as a participant in any activity. The workshop leader’s judgment shall provide the ultimate determination of an individual’s ability to participate in, or continue to participate in, any activity or program.
2. Arbitration
To the fullest extent permitted by applicable law, any claim, controversy, or dispute relating to the enforcement or interpretation of these Terms and Conditions, or arising from or relating to your registration, participation, or attendance at a Shutter Nonsense LLC workshop, shall be resolved by binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules and Mediation Procedures then in effect.
This arbitration agreement is intended to be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1-16, to the extent that Act applies. If the Federal Arbitration Act does not apply to a particular dispute or claim, Texas law, including Chapter 171 of the Texas Civil Practice and Remedies Code to the extent applicable, shall govern the enforceability and administration of this arbitration agreement.
The arbitration shall take place in Tarrant County, Texas, unless the parties agree otherwise or the applicable rules of the American Arbitration Association or applicable law require a different location.
BY AGREEING TO BINDING ARBITRATION, YOU UNDERSTAND THAT YOU AND SHUTTER NONSENSE LLC ARE WAIVING THE RIGHT TO HAVE A DISPUTE DECIDED BY A JUDGE OR JURY IN COURT TO THE EXTENT PERMITTED BY APPLICABLE LAW. ARBITRATION MAY ALSO PROVIDE MORE LIMITED DISCOVERY AND APPELLATE RIGHTS THAN WOULD BE AVAILABLE IN COURT.
Any arbitration award may be entered as a judgment by a court of competent jurisdiction.
Nothing in this provision requires arbitration of a claim that cannot lawfully be made subject to a pre-dispute arbitration agreement. If any portion of this arbitration provision is determined to be invalid or unenforceable as to a particular claim or dispute, that determination shall not invalidate the remainder of the provision to the extent the remaining portions can lawfully be enforced.
3. Cancellation or Change of a Workshop
While Shutter Nonsense LLC will make every attempt to operate a workshop once confirmed, we reserve the right to cancel or change a workshop at any time due to insufficient bookings and/or circumstances beyond our control that might create unsafe or undesirable conditions for participants.
If Shutter Nonsense LLC cancels a workshop, a full and immediate refund of workshop fees paid to Shutter Nonsense LLC will be issued.
The financial liability of Shutter Nonsense LLC shall be limited to the amount paid to Shutter Nonsense LLC for the workshop and shall not extend to other associated travel costs, including, but not limited to:

Non-refundable airline tickets

Clothing or equipment
-
Transportation costs
-
Medical expenses
-
Travel insurance premiums
-
Other expenses associated with preparing for or attending the workshop
We reserve the right to refuse acceptance of any participant, for any reason, at any time. We are not responsible for additional expenses incurred by such participants.
4. Cancellation and Refund Policy
We understand that attending our workshops requires an advance commitment and that circumstances may arise that force you to cancel.
If you need to cancel your registration for any reason, you must provide written notice of cancellation to Shutter Nonsense LLC. Cancellation becomes effective on the date the notice is sent, based on the postmark date for standard mail or the date and time sent for electronic communications.
There are no exceptions to this policy, including for medical emergencies.
Based on the effective date of cancellation:

More than 61 days before the workshop start date: Refund of workshop fees paid, less the workshop deposit.

Within 60 days of the workshop start date: No refund.
All refunds will be made using the same payment method as the original payment.
5. Use of Name and Likeness
We reserve the right to take photographs or videos during a workshop and to use the resulting photography, in whole or in part, for promotional purposes, including advertising and publicity in print and electronic media.
By registering for a workshop with Shutter Nonsense LLC, you agree to allow your image to be used in such photography. Participants who prefer that their image not be used should notify their workshop leader at the beginning of the workshop.
We also reserve the right to use, in whole or in part, written reviews or behind-the-scenes photographs you provide to us for advertising and publicity in print and electronic media.
6. Insurance
Unless you are already covered under an existing policy, we recommend purchasing travel insurance.
Travel insurance may provide coverage for losses associated with:

Trip cancellation or interruption
-
Travel delays
-
Lost baggage or travel documents
-
Baggage delays
-
Medical emergencies
-
Accidental death
You are responsible for determining whether any insurance policy provides coverage appropriate to your individual needs and circumstances.
7. Third-Party Services
You understand that we may rely upon third-party hotel operators, food providers, transportation providers, and other third parties to provide services associated with our workshops.
All tickets, coupons, reservations, and similar arrangements are subject to the terms, conditions, and policies of the applicable third-party service provider.
We cannot control the actions of third parties and do not assume responsibility for unanticipated events that may occur, including:

Travel delays
-
Lost luggage
-
Cancellations
-
Overbooking
-
Reservation errors
-
Other disruptions involving third-party services
You should build reasonable flexibility into your schedule in case we need to extend the length of the workshop or make other reasonable scheduling changes to accommodate unanticipated events.
You will not be entitled to a refund for scheduling changes required by such unanticipated events.
You further agree to hold Shutter Nonsense LLC harmless from and against liability for injury, death, damage, loss, accident, delay, or irregularity that may occur in connection with services provided by third parties.
8. Electronic Signatures
Except where hard copy signatures are mandated by applicable law or insurance regulations, the parties consent to executing this transaction electronically. Electronic signatures on these Terms and Conditions shall have the same legal effect as handwritten signatures. Each party agrees that an electronic copy of the signed Terms and Conditions may be retained and used as an original for all purposes.
